Hearings: 

It is expected that all attorneys will meet with there clients prior to a scheduled hearing and be prepared to proceed at the scheduled hearing.  These hearings are administrative, not criminal.  As a result, the burden of proof is a preponderance of the evidence.  Formal rules of evidence do not apply and all relevant evidence is admissible.  Hearsay and evidence that might be subject to the exclusionary rule in a criminal proceeding may also be deemed admissible.
