Contracting:

Title II of the ADA requires public entities to ensure that contractors operating programs and services on their behalf meet the same level of compliance that would be required of the public entity if they were operating programs and services directly.  Furthermore, California Government Code Section 11135 prohibits a public entity from discriminating on the basis of a disability in contracting out for provision of goods and services. 

Private entities are covered by Title III of the ADA.  In many situations, a public entity may have a close relationship with a private entity.  As a result, certain activities of the public entity may be affected by both Title II and Title III.
