HISTORY OF ARMSTRONG V. DAVIS 

1994 - Armstrong case was filed 

1995 - BPT was amended into the the Armstrong case as defendants

1996 - CDC settled and accordingly developed the Armstrong Remedial Plan (ARP)

1996 - BPT continued to litigate

6/1998- In Pennsylvania Department of Corrections v. Yeskey, the U.S. Supreme Court held that ADA applies to state prisons.

1999 - Trial held in Federal District Court 

12/1999 - Permanent Injunction was issued

In the Findings of Fact and Conclusions of Law, the Court found that the BPT to be in violation of Title II of the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act of 1973, and the Due Process Clause of the 14th Amendment.
