THE CIRCUMSTANCES WHICH GAVE RISE TO THE ARMSTRONG INJUNCTION

THE FOLLOWING IS TAKEN FROM THE FINDINGS OF FACT & CONCLUSIONS OF LAW LEADING TO THE BPT INJUNCTION:

  • BPT policies & procedures are insufficient to identify & provide accommodations to class members

  • BPT does not provide accessible facilities

  • BPT does not know which modifications or auxiliary aids & services are appropriate to ensure class members understand the proceedings

  • BPT does not have equipment to accommodate class members

  • BPT failed to take the 1st step toward compliance by doing a self-evaluation of programs & facilities to identify potential barriers

  • BPT relies extensively on complex & highly technical written forms to communicate with class members with cognitive disabilities

  • BPT accepts waivers of rights from developmentally disabled & learning disabled prisoners without any assurance they understand rights they are giving up or the consequences
