THE CIRCUMSTANCES WHICH GAVE RISE TO THE ARMSTRONG INJUNCTION
THE FOLLOWING IS TAKEN FROM THE FINDINGS OF FACT & CONCLUSIONS OF LAW LEADING TO THE BPT INJUNCTION:

BPT policies & procedures are insufficient to identify & provide accommodations to class members

BPT does not provide accessible facilities

BPT does not know which modifications or auxiliary aids & services are appropriate to ensure class members understand the proceedings

BPT does not have equipment to accommodate class members

BPT failed to take the 1st step toward compliance by doing a self-evaluation of programs & facilities to identify potential barriers

BPT relies extensively on complex & highly technical written forms to communicate with class members with cognitive disabilities

BPT accepts waivers of rights from developmentally disabled & learning disabled prisoners without any assurance they understand rights they are giving up or the consequences
