THE CIRCUMSTANCES WHICH GAVE RISE TO THE ARMSTRONG INJUNCTION

SPECIFIC INCIDENTS:

  • Some prisoners who use wheelchairs have had to crawl up stairs to get to hearings 

  • Mentally retarded prisoners who cannot spell their names have waived their right to a hearing

  • A blind parolee was denied access to information at his hearings because he could not see documents

  • Hearing impaired prisoners who normally express themselves by using sign language had their hands shackled at their hearings making such communication impossible
